Overview
The Family and Medical Leave Act (FMLA) may protect your job while you attend addiction treatment. Eligible employees can take up to 12 weeks of unpaid, job-protected leave for substance use disorder treatment.
Eligibility
- Not all employees or employers are covered by FMLA
- Eligibility depends on company size (50+ employees)
- Length of employment (12+ months)
- Hours worked (1,250+ hours in the past 12 months)
- Consult an employment attorney or your HR department for specific guidance
FMLA protects employees seeking treatment for substance use disorders. However, it does not protect against disciplinary action for workplace violations caused by substance use.
