Know Your Insurance Rights
Overview
The Mental Health Parity and Addiction Equity Act (MHPAEA) requires insurance plans that offer mental health and substance use disorder benefits to provide them at the same level as medical/surgical benefits. This means equal copays, deductibles, treatment limits, and prior authorization requirements.
Your Rights
- Equal copays and deductibles for addiction treatment
- No more restrictive treatment limits than medical/surgical care
- Equal prior authorization requirements
- Right to appeal denied claims
- Right to request criteria used for coverage decisions
Filing a Complaint
If you believe your insurer is violating parity requirements, you can file a complaint with your state insurance commissioner or the Department of Labor.
